COPYRIGHT AGREEMENT

1.1. Copyright.
All Images are the exclusive property and copyright of Luvliness and/or its licensors. The Images are protected by national copyright laws, international treaty provisions and other applicable laws.

1.2. What you CAN do with Images.
If you have made a purchase on the Website, then Luvliness grants you a non-transferable, nonexclusive license solely for personal use of the Images as described on the product listing. Personal use is defined as making something for yourself, or making something for a friend as a gift. If you would like to use these Images for commercial use, it will require additional licensing. Commercial use is defined as selling a finished product using Luvliness’ design(s). An example of a finished product would be a coffee mug, t-shirt or anything else where the design is applied. If you plan to sell something with Luvliness’ design(s), you will need to purchase a commercial license. Here is the link:

1.3. What you CANNOT do with Images.
Except as noted in Section 1.2. above, the Images may not be copied or reproduced in any manner whatsoever without the prior written consent of Luvliness as evidenced by a License, and subject to the payment of that License. All rights are reserved by Luvliness and its licensors.

1.4. Unauthorized Use of Images.
Unless you have received and paid for a License from Luvliness:

1.4.1. It is Illegal to copy or use any portion of any image whether (without limitation) by photographic means, scanning, digital copying, tracing, saving it to any computer, posting it to any Website, or as reference for another image.

1.4.2. It is illegal to incorporate all or part of any Image into another image. Changing an Image does not give you any right to use the changed Image. The original Image, however modified or distorted, is still protected by copyright.

1.5 Liability for Unauthorized Use of Images.
Luvliness and its contributing artist and licensors earn their living by designing and selling licenses to these Images. You agree that any Unauthorized Use of any Image by you is an infringement of copyright and that you will be responsible for any fees, damages and/or compensation arising from such unauthorized use.

1.6 Copyright infringement.
Luvliness will be entitled to, and you will pay, a compensatory fee equal to the greater of CAD $1,500 or 3 times the usual License Fee for each Unauthorized Use by you of any Image in addition to any other rights or remedies available to Luvliness under law (without you thereby acquiring any rights to the infringed Image).
